Frequently asked questions

Do all Property Registry procedures require the same documents?+

No. Requirements depend on the act to be registered, amended, cancelled or certified. For example, the Judiciary’s published requirements for an updated Folio Real include specific supporting documents and require lawyers or third parties to establish a direct and legitimate interest.

Can a lawyer or authorized representative handle the filing?+

The Public Property Registry’s published procedures contemplate, for certain filings, personal action or formal representation through a power of attorney, with proof of the required legal interest. The precise scope of representation should be checked for the specific procedure.

What should be reviewed before filing a registration?+

It is advisable to review the Folio Real, the underlying title, the parties’ identity, liens or encumbrances, prior observations and consistency between the document and registry data. Inconsistencies may lead to observations or an additional procedure.

Does a registry observation mean the right has been lost?+

Not necessarily. An observation means the registrar identified a requirement or issue that must be addressed. Its legal effect depends on the content of the observation and the instrument filed, so both should be reviewed before correcting the submission.
